Industrial design protects the overall visual appearance of a product, which is the ornamental or aesthetic aspect of a product, rather than the function of the invention. It consists of features of shape, configuration, pattern or ornament applied to an article by any industrial process or means, being features which, in the finished article appeal to and are judged by the eye. Industrial design can be used to deter others who might want to copy and commercialise a product with a similar appearance.

Design Identification Assessment

Industrial design protection is not automatic. The owner of a design has to file applications with the national offices in order to enjoy the exclusive rights of your design. Under the registration regime, the owner of an industrial design may, upon filing and successfully completing an application, register the design in respect of a specified article with the Registrar of industrial design.

International Protection

A first industrial design application, filed in Malaysia, may provide the basis for a priority claim for subsequent foreign applications that are filed within the 6-month priority period that starts from the Malaysian filing date.

A registered industrial design is given an initial protection period of five (5) years from the date of filing. The protection is extendable for a further four (4) consecutive terms. The maximum protection period is 25 years.
